Most states have enacted antitrust statutes modeled after the federal Sherman Act and Clayton Act. Pennsylvania, however, does not have a general antitrust statute.
Pennsylvania's Unfair Trade Practices Consumer Protection Law (UTPCPL), 73 P.S. §§201-1, addresses the impact of unfair business practices on consumers. This law was first enacted in 1968 (Public Law 1224, Act 387, HB 2431). A compiled legislative history of this statute, and its subsequent amendments, is available to members of the Jenkins Law Library.
The Pennsylvania Attorney General's Office, Public Protection Division, oversees antitrust enforcement actions in the Commonwealth.
